Terms of Service

1. Acceptance of Terms

By accessing or using DuDiBa ("the Service"), operated at https://dudiba.com, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

DuDiBa provides an AI-powered support chat widget that businesses can train on their documentation and embed on their websites. The Service includes document ingestion, AI-generated responses, conversation management, human handoff capabilities, and a management dashboard.

3. Account Registration

  • You must provide a valid email address and create a password to use the Service.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 18 years old to create an account.
  • You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that infringes intellectual property rights of others
  • Upload malicious, harmful, misleading, or inappropriate content for AI training
  • Attempt to reverse-engineer, exploit, or compromise the Service
  • Use the Service to generate spam, phishing content, or misleading information
  • Exceed reasonable usage limits or abuse API endpoints
  • Resell or redistribute the Service without written permission

5. Content Ownership

You retain ownership of all content you upload to DuDiBa (URLs, PDFs, documents). By uploading content, you grant us a limited, non-exclusive license to process, store, embed, and use it solely for the purpose of providing the Service (generating AI responses for your widget).

AI-generated responses are provided on an as-is basis. You acknowledge that AI outputs may be inaccurate and you are responsible for reviewing the quality of responses your widget provides.

6. Subscriptions & Billing

  • Some features require a paid subscription. Pricing is displayed on the billing page.
  • Payments are processed by Stripe or Razorpay depending on your region.
  • Subscriptions automatically renew unless cancelled before the renewal date.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from downtime.

8. AI & Third-Party Services

The Service uses OpenAI's APIs for text processing and response generation. Your content and visitor conversations are sent to OpenAI for processing. By using the Service, you acknowledge and consent to this data processing. We also use Supabase, Vercel, Stripe, Razorpay, and Resend as described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DuDiBa and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DuDiBa, its operators, and affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account by contacting us.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of India and the state of Karnataka. Any disputes arising from these Terms shall be resolved exclusively in the courts of Karnataka, India.
